Terms and Conditions
In these terms and conditions,
"We/us/our/ours" means the seller, "Rag Tag and Textile Ltd" (RagTag), Broadford Industrial Estate, Broadford, Isle of Skye, IV49 9AP
"You/your/yours" means the buyer/purchaser
"Goods" means the goods which we shall supply to you in accordance with the Contract
Methods of Payment
At the time of publication of these terms and conditions (24/03/2014), card payments are handled by PayPal or Stripe and must be made at the time of placing the order. If you prefer, you can pay by cheque, the cheque must be drawn on a UK bank and must be crossed 'A/C payee only'. Your name, address, phone number and card number must be written clearly on the back of the cheque.We will allow 7 working days for your cheque to clear before we process your order. In the event that you pay by cheque and your cheque is returned by payee bank as uncleared, you shall be liable for all reasonable costs incurred by us as a result.
Your online payment is processed by PayPal or Stripe. We do not store any of your financial information in our system.
PrivacyWe will not pass on customer details to any third party.
Currency and Prices
All prices shown are in GBP (£ sterling) and include all taxes applicable within the U.K. Whilst every effort is made to ensure prices are correct, occasional errors or other technical problems may result in inaccurate prices being shown. In such cases we are not required to honour incorrect prices. Prices are subject to alteration without notice; however once we have accepted and confirmed an order, the price for that(those) item(s) will not change.
Colours and Descriptions
Due to the nature of the items we sell, there will often be variation from item to item. Whilst we are happy to give advice on product use, we cannot accept liability as conditions of use are totally outside our control.
Every care has been taken to ensure that all colour representations are portrayed as accurately as possible and that all item descriptions are correct. However, due to differences in monitor and browser settings every computer screen will display colour differently. It is therefore impossible for us to guarantee that the colour of the item will be an exact match as seen on your screen.
We reserve the right not to accept or to cancel once accepted any order, without penalty. The customer may cancel an order without penalty only before we have accepted it (acceptance of the order makes a contract between us).
Delivery information and charges are given on the delivery page. These charges are subject to alteration without notice; however once we have accepted and confirmed an order, the delivery charge for that order will not change.
For a delivery address in the UK, we use Royal Mail Special delivery. Provided the goods are in stock, customers can expect delivery in 2 to 3 working days. However, a signature will be required upon receipt.
If the delivery address is outside the UK, we use the UK's Royal Mail International service. If in stock, goods will be despatched within 2 to 3 working days. Please note that a signature will be required upon receipt of the goods.
We will deliver the goods ordered by you to the address you give us for delivery at the time you make the order. However, please note that the delivery address of your first purchase must be the same as that which you registered with the online shop and also the same as the invoice address of the payment card you intend to use.This measure is to safeguard the security of our customers and to deter the fraudulent use of payment cards. For your second, or subsequent, purchase, you may specify an alternative delivery address if required.
We reserve the right to withhold delivery to any particular place or location at our sole discretion.
Outside the UK, the risk in delivery of the goods passes to you on the commencement of supply or transportation to you or, where you will not accept supply on the date of delivery, to temporary storage arranged by us or the postal / courier service making the delivery.
All RagTag and Textile Ltd items are handmade. Whilst every effort is made to despatch within 2 to 3 working days of receipt of order, this is not always possible. In the event that we do not have enough stock to complete your order, we will email or phone you to advise. You may wish to have your requested items back-ordered at that point, take part delivery or cancel the order. As each item we make is unique, please be aware that we can only offer similar, and not identical items.
Duties and Taxes
You are responsible for any duties, customs charges and/or taxes levied at the point of entry into the destination country.
Retention of Title
Under all normal circumstances, goods will be paid for prior to despatch (online payment will be processed immediately prior to despatch). Neither the ownership of, nor the title in any goods sold by us, will pass from us until such time as we have received cleared payment in full for such goods and any additional charges relating to such goods. Until such time, we reserve the right to recover possession of the relevant goods.
Damage in Transit
While we do our best to pack the Goods securely, we cannot accept any liability for any damage or deterioration in the Goods which occurs, for any reason, while the Goods are in transit to you. Deliveries within the UK are covered for up to £500 compensation against loss or damage, but are not covered for consequential loss.
Please contact us immediately if the goods arrive damaged. A full refund, including postage costs, will be made on receipt of the returned goods.
If, in the unlikely event that the wrong goods are supplied, please contact us straight away. A full refund, including postage costs, will be made on receipt of the returned goods.
Should you wish to exchange an item you must inform us, and return the goods within 7 days of receipt, you are responsible for the postage and safe return of the original goods and their packaging to us in their original, new, and unused condition.
The replacement item will be sent to you with no extra delivery charges within the UK. If the replacement item is a lower price to the original item, the difference will be refunded to you. If the replacement item is a higher price, the difference will be charged to you before the replacement has been despatched.
Please be aware that replacement items will be as similar as we can make them (we will advise on this), but due to the nature of items we sell, each piece is truly unique and cannot be made identical to any other.
Please contact us for exchanges of goods outside the UK.
Your statutory rights are not affected.
By using this website, you acknowledge and agree that all content (including but not limited to all images, text, graphics and actual products) is protected by copyright, and design rights, as applicable, are owned by RagTag and Textile Ltd (Ragtag).
You agree that you will not (nor assist or facilitate any third party to) commercially exploit or create derivative works from the products, branding, and other content on this site.
Our liability to you in contract law or in tort or otherwise howsoever arising in relation to these terms and conditions is limited to our charges for the goods. We will not be liable to you for any loss or destruction of the goods, temporary or otherwise, which occurs following use or application of the goods except and to the extent that it is caused by the wilful default of one of our employees. Although we will endeavour to ensure that the goods are safe to use, we will not, except insofar as it cannot exclude its liability for death or personal injury caused by its negligence, be liable for any damage (physical or otherwise), loss or expense caused either directly or indirectly by use.
We will not liable for any breach of these terms and conditions caused by matters beyond our reasonable control including acts of God, fire, lightning, explosion, war, disorder, flood, industrial disputes (whether or not involving our employees) , weather of exceptional severity or acts of local or central government or other authorities.
We reserve the right not to sell to any prospective customer at our sole discretion.
Sub-Contracting and Assignment
We may sub-contract any or all of its rights or obligations hereunder and may assign the benefit and burden of its rights and obligations hereunder to any other entity.
These terms and conditions constitute the entire agreement between the parties on the subject matter contained herein and supersedes all representations, communications and prior agreements between the parties in that regard. Each party acknowledges that upon entering into this Contract it does not rely and has not relied on any representation (whether negligent or innocent), statement or warranty made or agreed to by any person (whether a party to this Contract or not) except those expressly referred to in this Contract. The only remedy available in respect of any misrepresentation or untrue statement made to either party shall be a claim for damages for breach of contract under this Contract. This clause shall not apply to any statement, representation or warranty made fraudulently, or to any provision of this Contract which was induced by fraud for which the remedies available shall be those available under the law governing this Contract.
A person who is not a party to this Contract has no rights under the Contracts (Rights of Third Parties) Act of 1999 to enforce any term of this Contract, but this does not affect any other right or remedy of a third party.
Service of Notices
Any written notice required by this Contract should be sent to the address of the intended recipient shown overleaf. Notices can be sent by hand or by post.
Governing Law and Juristiction
This Contract and any relevant interaction between the parties shall be governed by and construed in accordance with the laws of Scotland and both parties agree to submit to the non-exclusive jurisdiction of the Scottish courts in relation to any claim, dispute or difference which may arise hereunder or in relation to any relevant interaction between the parties prior to this Contract.
These terms and conditions are subject to alteration by us without notice.
